The lawyer for the estranged husband who died after a fatal auto accident is seeking more than $150,000 in damages from his ex-wife, who he says was negligent in the care of their two young children.
“You have a life you would rather spend with someone else, and that person doesn’t deserve that kind of pain,” said Kim Anderson, the lawyer for her ex-husband, Stephen Anderson, in an interview with the Houston Chronicle.
The Harris County district attorney’s office has declined to prosecute, citing a lack of evidence.
The couple separated in 2013 and Anderson filed for divorce in March.
In his lawsuit filed Tuesday in Harris County Superior Court, Anderson claims he was unaware of the child abuse, neglect and death until after the child was born.
Anderson also said he is seeking “the right to recover damages from both parties,” including attorneys’ fees, and damages to be paid by the deceased’s estate.
She is represented by the Houston divorce lawyer Robert J. Fournier.
If Anderson wins, his lawsuit would be the second time the lawyer has sought damages against the ex-partner.
Anderson was awarded $9.8 million in an August 2013 divorce in Houston.
The lawsuit also claims the ex has been “a living, breathing nightmare.”
The couple separated at a time when he was suffering from depression and anxiety, according to the suit.
