When a wrongful death lawsuit is filed against you, you may be entitled to damages for wrongful termination.
If you were fired for cause or wrongfully terminated, the law requires you to file a claim for compensatory damages.
However, it’s often easier to settle a wrongful firing lawsuit in small claims court than it is to fight the lawsuit in a big court.
If the claim is not settled by settlement, the judge will order a trial to determine damages.
The court will award the plaintiff an award for actual damages, such as attorney fees and costs, but the judge can also award punitive damages, which are awarded if the company is found liable for wrongful conduct.
For example, if you were wrongfully fired from a small business, you could win punitive damages.
